I am in the same circumstance, the judge ordered me to have half of what my ex is Entitled to and Exxon has all of my information for pay out but IRS has already put a lein on the funds that my ex owes and since it is a federal issue they take presidence over the allocated funds. I have spoken to an attorney and they basically agree that IRS does have the right because the order that the judge signed states that I will ONLY recieve HALF of the funds that my ex has RIGHT to, and in my case the ex has no right also to the money so therefore we both will not get paid. The litigation has just been dealt with after 20 + years in the supreme court, anyone else have any suggestions? the elephant in the living room that no one talks :: And any law he made would be a religious one. legally he owes you have of whatever the settlement is. get a lawyer now. he breached the contract. either he can come up with half the settlement upfront or 4 yrs of child support upfront. i repeat GET AN LAWYER
your (divorce) contract is still a contract and he is in contempt of court if he breaks it. looks like he did that. file contempt charges.
he has no business using that settlement money to pay further debt.
the law didn't fool you.. your ex did.
the judge will NOT like that.
Legally you still own half of that settlement! Not paying the IRS is his responsibility; not your. There is a breech of contract and you can still get your money as long as you're willing to fight it in court. I am not sure how much money he owns you, but if you feel like the money is worth the trouble I say heck go head and do it.
